I think they need to hire better international lawyers, or this is just a media stunt. The problem is that Belarus has never ratified the Rome Statute, so it is beyond the ICC’s jurisdiction. It’s different from Russia and Israel because there jurisdiction is established through Ukraine’s recognition of the ICC’s jurisdiction (and now it’s going to ratify the Rome Statue) and Palestine’s accession to the ICC system. The only way the ICC can get jurisdiction over Belarus now is through a Security Council authorisation, but that is also unrealistic given Russia’s veto.
