    Same supermarket as [this one](https://old.reddit.com/r/europe/comments/1gx1u7h/spanish_court_upholds_ruling_that_supermarket/).

    Translation:

##A Mercadona employee is fired for weighing a squid after cleaning it to make it cheaper and the court declares it unfair

The supermarket chain claimed that, after cleaning, the squid lost between 300 and 400 grams. Hence, they understood that the employee had weighed it afterwards, to make it cheaper.

The High Court of Justice of the Canary Islands declared unfair the dismissal of a Mercadona employee who cleaned a squid before weighing it and subsequently bought it, allegedly, according to the company, with the intention of taking it cheaper. According to the court, although the company’s rules prevent this practice, the fact was not serious enough to justify the dismissal.

As stated in the 2022 judgment, the employee in question had been working for Mercadona since 2015 when, in October 2021, he was notified of his dismissal with immediate effect. The reason was the events that occurred that same month, when, “in the absence of his colleague, he prepared a squid, which he weighed and kept in the ice machine without a ticket” and, subsequently, at the end of his day, “he went to the checkout line to pay for the product, although the ticket was in his pocket and not in the bag”.

At the request of the coordinator, they went to her work station in the fish market and her colleague, again at the request of the coordinator, separated a similar squid, weighed it, cleaned it and weighed it again, there being a difference in weight of 320 grams (the company alleged that there was always a difference of between 300 and 400 grams). Hence, they understood that he had weighed it after cleaning it so that it would be cheaper for him. According to the company’s rules, to buy a product from the fishmonger, it had to be a colleague who weighed the product and generated the ticket, so that he could buy it at a lower price. According to company rules, to buy a product from the fishmonger, a colleague had to weigh it and generate the ticket, which the employee could then prepare for it.

This is very common in Spain. An employee with my organisation was awarded €200,000 recently for unfair dismissal, but they had a much higher level job.
