This is something that both insurance companies will look into if they can’t agree then the matter would be referred to arbitration.
I would say that the truck driver is at 100% fault irrespective of you were packed badly or not as he should have avoided a stationary object. If he couldn’t pass then he should have waited.
“enough space to pass” is a bit of a cop out in my experience. Double yellows are there for a reason.
You could just get a fine. But the damage has been done to your car so its insurance matters and knowing them they would do 50/50.
If I was the company of the vehicle that got damaged I would also look into the damages sustained by the vehicle that hit you due to your illegal parking.
If he hit you in your bumper with his, then yes. But I imagine he hit your side or something of the sort and that requires warden/police intervention as it’s not a bumper to bumper and will null the claim if you fill it in. So allow the police and insurers to do their work or else get a quote for the fix and deal with the company directly not with the driver.
A car that is not.moving can never be at fault. If he could not have passed he should not have driven past your car.
Then again, you are a kind of an ass for parking illegally.
Insurance won’t pay out if you were illegally parked!
Now imagine how good you’d feel if you parked legally. Insurance probably won’t pay lol.
You were parked illegally, so you might be held liable for the damage to both vehicles, only thing you have on your side legally is that he kept on driving which might be seen as the driver admitting fault. Though I hope you get all the blame as parking on a corner obstructs drivers field of view and it was a double yellow so you parked there knowing you shouldn’t have, no one cares why you parked on a double yellow, shame on you for playing the victim card.
